Action in the Martin County District Court for personal injuries allegedly sustained by plaintiff as a result of using a product
manufactured by defendant Wilmington Chemical Corporation and sold to him by defendant Paul Brandt. Defendant corporation
filed a third-party complaint against E.I. du Pont de Nemours & Company and Shell Oil Company seeking indemnity. After
settlement of the main action, the third-party action was tried before L. J. Irvine, Judge, and a jury, which found in a special
verdict that defendant corporation was negligent proximately causing injury to plaintiff; that third-party defendant Shell
was negligent proximately causing defendant corporation's loss; that third-party defendant du Pont was not negligent proximately
causing the loss; and that the negligence of defendant corporation superseded the negligence of Shell. Thereafter, the court
ordered judgment in favor of both third-party defendants, and defendant corporation appealed from an order denying its alternative
motion for amended findings or for a new trial and its motion for a new trial as to third-party defendant du Pont. AUTHOR: KNUTSON
